In the matter of the Motion for Inhibition filed by protestee Maria Laarni L. Cayetano against Commissioner Elias R. Yusoph, the Special Second Division of the COMELEC ruled:

“Nevertheless, considering that Commissioner Lucenito N. Tagle voluntarily inhibited himself and that Commissioner Armando Velasco belongs to the First Division, Commissioner Yusoph is left as the only member of the Commission belonging to the Second Division where the instant case is originally assigned. To prevent further imputations of dubious character as to the impartiality of whatever ruling of this Commission as regards the case at bar resulting to the smearing of the integrity of this august body, the Commission (Second Special Division) hereby resolves to re-assign the instant case to the Commission (First Division).”
